Terms and Conditions for Equipment Hire from Kooltech Trailers Ltd.

1. Introduction

Welcome to Kooltech Trailers Ltd. These terms and conditions outline the rules and regulations for the hire of equipment from our company. By hiring any equipment you accept these terms and conditions in full. If you disagree with any part of these terms, you should not hire our equipment.

2. Definitions

• Hirer: The individual or entity hiring the hire equipment from the company.

• Company: Kooltech Trailers LTD, the provider of the hire equipment.

• Definition: The word ‘equipment’ shall include the trailer and accessories.

3. Hire Period

• The hire period commences on the date agreed upon in the hire agreement and ends on the return of the trailer to the company.

• Any extension of the hire period must be agreed upon in writing by the company.

4. Charges and Payment

• The hire charges are as agreed in the hire agreement and must be paid prior to the commencement of the hire period unless otherwise agreed by the company.

• A security deposit may be required, refundable upon the satisfactory return of the trailer.

5. Use of Trailer and Equipment

• The hire equipment must be used solely for the purpose for which it is designed and in a lawful manner.

• The hirer must not make any alterations or additions to the hire equipment without the company’s prior written consent.

• The hirer must ensure the trailer is not overloaded and is adequately secured at all times.

6. Maintenance and Repair

• The hirer must ensure that the hire equipment is maintained in good working order.

• The company is responsible for routine maintenance; however, the hirer must report any damage or defects immediately.

• Any damage caused due to negligence or misuse by the hirer will be charged to the hirer.

7. Risk Ownership and Insurance

• The hirer must ensure that they have adequate insurance coverage for the equipment during the hire period.

• Evidence of insurance must be provided to the company upon request.

• Ownership of the hire equipment remains at all times with the company. The hirer, has
  no right, title or interest in the hire equipment.

8. Liability

• The company shall not be liable for any indirect or consequential loss or damage arising from the use of the hire equipment.

• The hirer shall indemnify the company against all loss, damage, or injury to any person or property caused by the hirer's use of the hire equipment.

9. Termination

• The company reserves the right to terminate this agreement immediately if the hirer breaches any of these terms and conditions.

• Upon termination, the hirer must return the trailer to the company immediately.

10. Governing Law

• These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales.

11. Complaints and Dispute Resolution

• Any complaints should be addressed in writing to Kooltech Trailers Ltd.

• In the event of a dispute, both parties agree to attempt to resolve the issue through mediation before proceeding to legal action.

12. Amendments

• The company reserves the right to amend these terms and conditions at any time. Any changes will be communicated to the hirer in writing.
